Contract Agreement for “Consignment by Listing”

Olde Towne Piano Shop agrees to provide advertising with allocated space for Consignment by Listing on www.townpiano.com web site for the specified Instrument and Owner/Consignor, named below, under the Terms of this Agreement. The initial Set-up Fee of $350 for each Ad will be made “live” when ALL requirements are properly met. The Ad may remain in the Listing until the piano is sold, or unless proper response for renewal was not received within each 90-day term, or at the Consignor's request to remove the Listing. The Owner understands that the paid Set-up Fee is non-refundable if the instrument does not sell.

The Appraised Value by an authorized Registered Piano Technician, member of the Piano Technicians Guild is $ . The Commission or Brokerage Fee charged is based on actual Selling Price of the instrument and due the day of the Sale.

Under this Contract Agreement for “Consignment by Listing,” the Owner understands that the negotiation of the Sale of the named Instrument is entirely made by Olde Towne Piano Shop.

Commission Payment or Brokerage Fee Agreement

A Commission Payment or a Brokerage Fee for referral of buyer and negotiating the deal for Sale of the instrument/piano for the owner is based on the final Selling Price (not including any applicable Maryland State Sales & Use Tax or Delivery/Moving Fees.) At the time the Instrument sells, the Owner/Consignor agrees to pay 10% of the Selling Price to Olde Towne Piano Shop, a Commission Payment or a Brokerage Fee. The Consignor understands that this amount is above the Set-up Fee for Consignment Listing on Olde Towne Piano Shop's web site, www.townpiano.com.

The Consignor understands the Sale Proceeds, less the Commission of 10% will be paid indirectly through Olde Towne Piano Shop after the Sale.

I, the Owner/Consignor, commission Olde Towne Piano Shop/Consignee to sell the Goods listed below for the best and highest Selling Price set by the Consignee. I certify that I am the Owner of the listed Goods and have a good title and the right to sell and that it is free from all encumbrances. I, the Owner/Consignor agree to accept all responsibility for providing the title and for delivery of the title to the Consignee for the purpose to transfer tile to the purchaser. I agree to hold harmless Olde Towne Piano Shop, its officers, employees or representative from any damage and/or liability arising out of or incurred in connection with the Goods. I HAVE READ AND ACCEPT THE TERMS OF THIS CONTRACT.
